For the purposes of this Privacy Policy, all references to Fans CRM shall be deemed to include its related companies (including all subsidiaries), its divisions and other companies that are part of its corporate group, its suppliers, and licensors, as well as its employees, directors, administrators, shareholders, agents, subcontractors, partners and other representatives.
This Privacy Policy applies to the information we collect through or in association with our website located at www.fans-crm.com, the other Fans CRM applications, websites and services or otherwise through your interactions with us (collectively the “Services”). Fans CRM and its affiliates may share information with each other and use it in a manner that is consistent with this Privacy Policy.
In addition to this Privacy Policy, your use of the Services is also subject to the Terms of Service and any other terms that may be communicated to you from time to time. This Privacy Policy applies regardless of the means used to access or provide information through the Services.
If you do not agree to comply with these terms and conditions regarding our collection, use, communication, sharing, and management of personal information set out in this Privacy Policy, please do not use the Services and cease using them immediately. By accessing the Services, you agree to this Privacy Policy and consent to our collection, use, disclosure, retention, and protection of your personal information as described in this Privacy Policy.
PERSONAL INFORMATION THAT IS COLLECTED
Personal information is generally defined by applicable privacy or data protection laws as information about an identifiable individual. An identifiable individual is one who can be identified directly or indirectly, by reference to an identifier such as a name, an identification number, location data, an online identifier or by one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that individual.
The types of personal information that we collect depends on your interactions with us and your use of the Services. We collect information that you provide to us directly when you use or access the Services (ex: when you register for an account), information that is automatically collected through your use of the Services and information which is provided to us from other sources such as our service providers.
Information You Provide
You may choose to give us personal information when you use our Services. This information may include your name, phone number, email address, postal address, billing information, date of birth and other relevant information about you or your company. This type of information is collected by the following means:
Your profile Information. You give us information when on register and create a user account which will be used to verify your identity when you access the Services, including your username, password, date of birth, email address and/or telephone number and information you disclose in your profile.
User Content and Behavior Information. We collect and process the content you generate and view on the Service, including but not limited to the preferences you set, the videos, photographs, and audio you upload and the comments you make (“User Content”). We collect User Content through pre-loading at the time of creation, import, or upload, regardless of whether you choose to save or upload that User Content in order to provide personalized recommendations. If you apply an effect to your User Content, we may collect a version of your User Content that does not include the effect. We may access content, including text, images, and video, found in your device’s clipboard, with your permission. For example, if you choose to initiate content sharing with a third-party platform or choose to paste content from the clipboard into the Service, we access this information stored in your clipboard in order to fulfill your request. We also collect information regarding your use of the Services e.g., how you engage with the Services, including how you interact with the content we show to you and the videos you watch.
Surveys and Promotions. We collect information through surveys, marketing campaigns and other events in which you participate. We use the personal information collected to communicate with or notify you about any campaigns, promotions, or special offer and generally to manage your participation.
Direct Messages. When you communicate with others using direct messages, we collect the content of the messages and the associated metadata such as the time when the message was sent, received and/or read). We use this information to block spam, detect crime and to safeguard our users.
Purchase Information. Ordering or purchasing. When you make a purchase on the Service, we will use the personal information that is collected to process your request, to complete your transaction using the payment services offered by our preferred third-party payment services provider and when applicable, to deliver any information you may request on the Service.
Information that is Automatically Collected
Other personal information is automatically collected when you use our Services, including your IP address, the domain name and host from which you access the internet, the pages of the website that you visit, your browsing history, your browser software or operating system and your browser’s country setting.
Consulting the content on the Websites. When you browse our Services, information pertaining to your user behavior is collected by cookies and other technological means, as further described below. This personal information is used to personalize the content displayed on our Services and to improve the content recommendations intended for you.
IP addresses and navigation routes. We collect the IP addresses (internet protocol) of all visitors to our website and their browsing history, as well as other information such as the pages visited immediately before or after our website, the pages requested, the type of browser, the operating system, your internet service provider, the number of times you have visited our website and the date and average time you spend on our website. A professional web analysis service. We can also use third parties, including Google, to:
Remarket, which consists of advertising to individuals who have already visited our website through other websites including through Google Analytics (internet audience analytics solution); in such a case, relevant third parties, including Google, may advertise our content on sites across the internet;
Use the following features of Google Analytics: the creation of reports based on the saved impressions on Google Display Network (a service that lets you place ads on a variety of news sites, blogs and other niche sites) to attract more potential customers; integration with DoubleClick Campaign Manager (management tool including a set of features used for advertising as well as targeting and monitoring advertising campaigns on websites and mobile devices linked to them, as well as the creation of Google Analytics reports on the demographic data of internet users and their interests);
Collect, analyze and/or gather your personal information (such as internet users’ IP address, sex, age, and interests), as well as create Google Analytics reports on the demographic data of internet users and their interests, in order to help us understand how visitors interact with our website and to improve our products and our websites.
The companies conducting remarketing can combine the use of first-party cookies (such as the Google Analytics cookies for example), and third-party cookies (like DoubleClick cookies), to (i) gather personal information; (ii) to inform, optimize and advertise based on your previous visits on our websites; and (iii) to determine the relationship between the registered visits to our websites and the advertising impressions, the other uses of advertising services and the interactions with these advertising impressions and these advertising services. To measure the effectiveness of our ads, these companies may also use tracer tags or web beacons to account for certain information regarding your visits to our websites and to the websites that have links to our site and that advertise it. Other Security Specific Features. Certain security-specific features of our Service may scan and analyze your files or network for security vulnerabilities and automatically collect certain information, such as IP address, device ID, MAC address, Mobile/PC environment, file metadata, URLs, Domains and IP addresses of websites visited, user or application behaviours, personal information contained within email content or files to which Fans CRM is provided access, information from suspicious emails, including sender and receiver email address, and attachments, network connection information, debug logs, network architecture/topology or screen capture of errors.
Content Characteristics and Features. We detect and collect characteristics and features about the video and audio recordings that are part of your User Content for example by identifying objects and scenery, the existence or location within an image of a face or other body parts and the words spoken in your User Content. We do this for content modernization and to provide special effects.
Information from Other Sources
Business Partners
If you choose to register or use the Service via third-party service provider that integrates with the Service, you will provide us or allow them to provide us with your username, public profile, and other possible information related to such account. We will likewise share certain information with your social network such as your app ID, access token and the referring URL.
Advertisers, Advertising Networks, and Analytic Providers
We use the information collected from you, and your interaction with the Service and other third-party sites, to infer your likely interests to provide you with more relevant advertising. This information tells us about websites you’ve visited, apps you’ve downloaded and purchases you have made so that we can predict what else might interest you in the future and assess how effective the advertising on our Service is. We collect this information by the use of Cookies and similar technologies on our Service and from similar information received from third parties who advertise on our Service and whose sites you visit.
We use all the personal information described above for legitimate purposes which are detailed in the next section.

Ensuring that user content is presented in the most effective manner for you and your device and that the content received and provided to you is tailored content that will be of interest to you;
Promoting our Services through marketing communications, contests and promotions and to facilitate sale and purchase of goods and services;
Complying with applicable laws, regulations, rules and requests of relevant law enforcement and other governmental agencies or for other purposes as permitted or required by law; and
Enforcing our terms of service and other usage policies.
we will collect information about your use of a Service to enable certain product features to operate, to improve the user experience, to generally improve and develop our Services, to inform our clients on the overall use of the Service and to provide training and support, to send technical notices, updates and security alerts.
We process information about your followers, the likes you receive and responses to content you upload, for the purposes of promoting your content to other users and exploring whether your profile presents further opportunities for collaboration. Where appropriate, we will also use this information for the purpose of serving personalized advertising and to tell you about new services and opportunities.
We will not use any personal information that we collect for materially different, unrelated or incompatible purposes without providing you with notice and first obtaining your consent.
DISCLOSURE OF PERSONAL INFORMATION
Principle. Unless specifically stated in this Privacy Policy, we will not disclose, trade, rent, sell or otherwise transfer your personal information, without your consent. Access to your personal information is restricted to Fans CRM, more specifically to their personnel, management, technical, sales and marketing and human resources teams who need access to this personal information as part of their functions for Fans CRM.
Exceptions. We may transfer your personal information to:
Service Providers, i.e., third parties (or otherwise make your personal information available to them) who provide services to support our business. Our service providers are given the information they need to perform their designated functions, and we do not authorize them to use or disclose personal information for their own marketing or other purposes.
Business Partners: we may disclose your information to our business partners in order to support our business operations and to allow us to provide our Services to you. We do not authorize them to use or disclose personal information for their own marketing or other purposes.
Legal Purposes: we may disclose your information to entities, organizations, and authorities for legal purposes. In other words, we and our service providers can disclose your personal information in response to a search warrant or other legally valid inquiry or order, or to an investigative body in the case of a breach of an agreement or contravention of law, or as otherwise required or permitted by applicable law. Our Services may contain links to other third-party websites that Fans CRM does not own or operate. The linked websites have separate and independent privacy statements, notices, and terms of use, which we recommend you read carefully. We do not have any control over such websites, and therefore we have no responsibility or liability for the manner in which the organizations that operate such linked websites may collect, use, or disclose, secure and otherwise treat your personal information. Your access to third-party websites is at your own risk.
RIGHTS REGARDING PERSONAL INFORMATION
You have certain rights regarding the collection and processing of your personal information. These rights vary depending on the laws that apply to you but may include:
The right to know whether and for what purposes, we process your personal information;
The right to be informed about the personal information we collect and/or process about you;
The right to learn about the source of the personal information about you that we process;
The right to access modify and collect personal information about you.

In general, you can access and edit most of your profile information by signing into the Services. You can delete the User Content you uploaded. We also provide several tools in Settings that allow you to control, among others, who can view your videos, send you messages, or post comments to your videos. Should you choose to do so, you may delete your entire account in the settings section. You may also be afforded rights in your country under applicable laws such as the ability to access your data, delete your data, and potentially others. SECURITY OF PERSONAL INFORMATION
We have implemented, and we apply administrative, organizational, technical, and physical measures aiming to protect the personal information in our custody and control against unauthorized access, use, modification, and disclosure. While we endeavor to protect and keep private such personal information, we cannot guarantee or warrant the security of your personal information against unauthorized disclosure resulting from hardware or software failure or other activities that may compromise the security of your personal information.
We retain your information for as long as it is necessary to provide you with the Services except in cases where we will retain information for as long as we have a legitimate business purpose to maintain the information or a legal obligation to maintain the information. We have personal information retention processes designed to retain personal information of our customers for no longer than necessary for the purposes stated above or to otherwise meet legal requirements. The retention periods will be different depending on the type of information and the purposes for which we use the information.
ACCESS TO YOUR PERSONAL INFORMATION
You have the right to access, update, and correct inaccuracies in your personal information in our custody and control, subject to certain exceptions prescribed by law. You may request to access, update, erase, restrict and correct inaccuracies in your personal information that we have in our custody or control by emailing or writing to us using the contact information provided in the “Contact Us” section set out below. We may request certain personal information for the purposes of verifying the identity of any individual seeking access or update to their personal information records. COLLECTION OF PERSONAL INFORMATION FROM CHILDREN
Our Services are not intended for anyone under the age of 18. Anyone under the age of 18 is not permitted to use the Services and we do not knowingly collect information from children under the age of 18. By using the Services, you represent that you are 18 years of age or older. INTERNATIONAL TRANSFERS
Your personal information may be stored and/or processed outside of your country of residence and may be shared with other members of our corporate group outside of your country of residence. By using the Services, you acknowledge that we may transfer your data to and store your personal information in countries which may have different data protection rules than in our country of residence. For transfers of personal information outside of the European Economic Area (EEA), pursuant to Section 46 of the General Data Protection Regulations (GDPR), we will use data transfer agreements which are subject to EU-approved standard contractual clauses.

Fans CRM reserves the right, at any time to modify, alter and/or update this Privacy Policy to reflect changes to the applicable laws or to our personal information practices. The revised Privacy Policy will be posted on our Services and any such modifications, alternations or updates to the Privacy Policy will be effective upon the posting of the revised Privacy Policy on our Services. Your continued use of the Services following out posting of any revised Privacy Policy will constitute your acknowledgement of the revised Privacy Policy.
WITHDRAWING YOUR CONSENT TO THE RETENTION, USE AND DISCLOSURE
You may withdraw your consent to our retention, use or disclosure of your personal information at any time by contacting us as set out below in the “Contact us” section or by changing our device permission or in-app settings. However, if you withdraw your consent, we may not be able to respond to your requests, process your requests or provide you with any help regarding the Services.
